Towards a New Generation of European Groupings of Territorial Cooperation

The European Grouping of Territorial Cooperation or EGTC allows public entities from two or more Member States to come together under a new entity with an own legal personality. The EGTC was established by Regulation (EC) 1082/2006, and since its entry into force in 2007 the number of EGTCs has been steadily growing: In this moment, 46 of them have been registered by the Committee of the Regions (CoR). Lately, Regulation (EU) 1302/2013 has amended the legal framework of the EGTC,
introducing new elements tending to reduce red tape in their constitution and to enlarge the scope of participation in these groupings, allowing certain private entities to be part of them, and establishing the conditions for the participation of entities from non-EU Member States. Other dispositions in the Common Provisions Regulation and in the Regulation on European Territorial Cooperation foresee new opportunities for the EGTC in implementing actions of regional policy. These changes, together with the lessons learnt from the past, allow us to foresee a new generation of EGTCs both from the legal and from the operational point of view.
